Following the Malaysian Government’s announcement that the Movement Control Order (“MCO”) period will be further extended to 12 May 2020, the Royal Malaysian Customs Department (“RMCD”) has announced that there will be a full remission of penalty available for specific indirect tax payments received by RMCD no later than 31 May 2020.

On 30 April 2020, RMCD announced that due to the unavoidable limitation of the MySST system, late payment penalties for the following taxable periods will continue to be automatically generated in the MySST system during the MCO period, in a manner as shown in the table below:

However, RMCD has clarified that a full remission for the above-mentioned late payment penalties will be made by the RMCD as soon as possible. This will also include any Bill of Demands (“BODs”) issued on penalties which are eligible for a full remission during the MCO period. In addition, we wish to highlight that an application for the remission of such penalties is not required.

The Prime Minister of Malaysia announced on 1st May 2020 that most businesses will be allowed to resume starting 4th May 2020, after the Movement Control Order (“MCO”) started on 18th March 2020. MCO is now to end on 12th May 2020. In line with this, the Immigration Department of Malaysia has on 2nd May 2020 evening released a general statement regarding resumption of the department’s services.

  1. All foreigners who have overstayed from 1st January 2020 till 14 days after the end of MCO, can leave Malaysia without being blacklisted or issued compound.
  2. All pass facilitation for foreigners whose Pass has expired from 1st February 2020, can be done at any immigration office within 30 working days from the end of the MCO period.
  3. All appointments for immigration counter services (except Visa, Pass, Permit Division and Expatriate Division) have to be done through the online system at  www.sto.imi.gov.my which can be accessed starting 8th May 2020 (Friday). No appointments are needed for transactions at the Security and Passport Division.
  4. All immigration counter services at UTCs nationwide will resume operations after the end of MCO period.

In conjunction with Labour Day, Y.A.B Tan Sri Muhyiddin Yassin, Prime Minister of Malaysia provided a special message for the public. Starting from May 4th 2020, the Movement Control Order (MCO) will be  slightly relaxed and most businesses will be able to open. Here are the key takeaways:

  • Starting May 4th, almost all sectors of the economy and business activities will be allowed to operate subject to the conditions and SOPs set by the authorities.
  • The nation was losing about RM2.4bil daily during MCO to break the spread of Covid-19 infections, with the total loss so far estimated at about RM63bil.
  • No sporting events, all religious activities, sports and recreational activities involving large gatherings would still not be allowed.
  • Jogging, cycling, etc will be allowed as long as social distancing maintained.
  • Inter-state travel, including to return to hometowns for Hari Raya Aidilfitri, would still be disallowed unless it is meant for work, to return home after being stranded in hometowns or other places.
  • Currently, all schools, colleges, and institutions of higher learning remain closed and has not been re-opened.
  • A complete list of unauthorized businesses or activities can be referred to the National Security Council website
  • Restaurants allowed to operate starting May 4th but with social distancing
  • To ease public transport congestion, companies are advised to provide flexible working hours.
  • Companies advised to continue practicing a work-from-home policy even with the loosening of the rules.
  • For facilitating contact tracking, the government has established these applications MySejahtera and MyTrace.
