Section 3(1) of Personal Data Protection Act 2010[1] (“the Act”) provides that “This Act shall not apply to the Federal Government and State Government”. So, what do Federal Government and State Government mean in this context? Section 3 of Interpretation Acts 1948 and 1967[2] (“IA 1948 and 1967”) then defines the Federal Government as the Government of Malaysia and State Government as Government of a State. The question here is whether the definition in section 3 is broad enough to cover government agencies.

To date, there are no cases that interpret the meaning of Federal Government or State Government in the context of the Act and this makes the definitions too general and broad. Therefore, since there are no clear limitations or restrictions by any statutes and case laws to the definitions provided in the above, it can be argued that the definition of Federal Government may also include the government agencies since these agencies are invariably part of the government.

The General Insurance Association of Malaysia said insurance providers have made certain waivers to expedite claim settlements made by flood victims.

Chairman Antony Lee Fook Weng said this included waiving the need for a police report, setting up additional hotlines and providing loss adjusters at the scene.

“We are actually removing some of the requirements. Some insurers are also able to give emergency cash immediately. In some cases, up to RM5,000 are given depending on the policy (with flood cover), without even having to go through the full process (of claims) because we understand during this time of need, cash is needed quickly,” he said on Bernama TV’s The Brief programme yesterday.

Heavy downpour in the Klang Valley that started on Friday, 17 December, has left over 32,000 people in Selangor displaced and at least eight dead, compounding the already difficult economic and living situation due to the ongoing COVID-19 pandemic. 

Non-profit humanitarian aid organization Malaysian Relief Agency (MRA) told Sinar Harian that it estimates the repair cost for property owners affected at between RM 5,000 and RM 10,000 per house, taking into consideration the large-scale damage caused with the houses submerged in water, each household’s electronic and electrical appliances, vehicles damaged among other factors.

In the wake of this devastation, several organizations have requested supplies, services and/or funds for flood relief efforts.

Kuala Lumpur, December 20, 2021 – With the aim of inspiring healthy active lifestyles, the Herbalife Nutrition Virtual Run held in October 2021 garnered more than 5,000 participants in Malaysia, collectively covering a distance of over 321,000 kilometers! This contributed to more than 25,000 runners across the Asia Pacific region running more than 1.57 million kilometers in the month-long event. At the same time, the total distance collectively achieved by the participants across the APAC region this year is nearly three times last year’s distance – enough to circle the earth almost 40 times.

As part of the company’s Get Moving With Good Nutrition campaign, 2021 marked the second year of the virtual run, to help people keep motivated to exercise amidst the challenging situation for the past two years.
