On the 17th of April, AMCHAM spent the morning at the Malaysia Digital Economy Corp (MDEC) office learning about data centers in Malaysia and how the Chamber can be of support.

Led by Tan Tze Meng, Head of the Digital Infrastructure Department at MDEC, the session provided a comprehensive understanding of Malaysia’s burgeoning data center industry. We learned about key factors driving Malaysia’s emergence as a regional hub, including cost efficiency, access to skilled talent, and robust data governance laws.

The Minister of Human Resources of Malaysia has by Gazette Notification P.U.(B) 128/2024 determined that the Occupational Safety and Health (Amendment) Act 2022 (“Amendment Act”) will come into operation on 1 June 2024.

The following subsidiary legislation, gazetted on 2 April 2024, will also come into operation on the date when the Amendment Act comes into operation:

  • Occupational Safety and Health (Plant Requiring Certificate of Fitness) Regulations 2024 [P.U.(A)
    99/2024]; and
  • Occupational Safety and Health (Licensed Person) Order 2024 [P.U.(A) 100/2024].

The Factories and Machinery Act 1967 will be repealed by the Factories and Machinery (Repeal) Act 2022, and the relevant requirements subsumed into the Occupational Safety and Health Act 1994 when the Amendment Act comes into effect.

The amendments under the Amendment Act are far reaching and will extend the application of the Occupational Safety and Health Act 1994 to all places of work in Malaysia.
