SUMMARY:[Virtual] Export Administration Regulations & Implications for Malaysian Operations
DESCRIPTION:Join AMCHAM for an in-depth discussion on the sweeping new changes to the [Virtual] Export Administration Regulations on Monday\, 28 November 2022 from 8.30 AM – 10.00 AM. Nathan Bush of DLA Piper will share his insights and participate in a Q&A session moderated by Siobhan Das\, AMCHAM’s CEO. \nPlease note that these new regulations are open to comments up until December 12\, 2022. \nOn October 7\, 2022\, the Department of Commerce’s Bureau of Industry and Security (BIS) released an interim final rule (Interim Final Rule) that implements several new export controls to restrict the People’s Republic of China’s (PRC) ability to obtain certain advanced computing\, semiconductor and related manufacturing items from the United States and overseas sources that rely on US technology. \nThe BIS then took the unusual step of scheduling a public online briefing to discuss the interim rule. \nOperators of facilities in Malaysia would be particularly concerned because sweeping new changes to the Export Administration Regulations (EAR) apply both to US-origin items and items developed or produced outside the United States that are the “direct product” of US technology\, software\, plant or manufacturing equipment: \nAs with many U.S. export control measures\, the ramifications of the new rules depend heavily on the precise classification of specific items (including goods\, software\, and technology) under the EAR. \nAlthough the scope of the new rules aims to focus precisely on a relatively “narrow” range of very advanced supercomputer and IC products and technology\, the new requirements with respect to these products are remarkably “deep” and far-reaching. \nSUBMIT YOUR QUESTIONS: To contribute a question to the Q&A please alert us and we will arrange for a short call with you before Friday\, 25 November\, or email to gr@amcham.com.my \nEvent Details: \nDate: 28 Nov 2022 (Monday) \nTime: 08.30am – 10.00am \nPlatform: MS Teams \nFor more information\, please email the AMCHAM Events team at events@amcham.com.my
