DESCRIPTION:Join us in this important webinar featuring Deloitte and KPMG where they will share their thoughts on the latest development of “Place of Business” (POB)\, and profit attribution exercise. \nThe introduction of Sections 12(3) and 12(4) of the Malaysian Income Tax Act 1967 (the Act)\, effective from 28 December 2018\, provides more certainty in assessing whether the business profits of a non-resident that is from a non-treaty country (e.g. US\, Jersey etc.) would fall within the Malaysian income tax net. However\, there are several grey areas in the law itself and as such\, the issuance of the Guidelines on the Application of Subsections 12(3) and 12(4) of the Income Tax Act 1967 in Determining a “Place of Business” are useful as they alleviate a number of uncertainties. \nWith this\, certain operations carried on in Malaysia by non-residents from non-treaty countries may constitute Place of Business (POB) in Malaysia because of the rules/guidelines that result in: \n\nCertain activities are no longer considered preparatory or auxiliary when the overall nature of the business is considered;\nThe expansion of the agency POB definition such that sales/ marketing activities without contract conclusion may nevertheless trigger a POB\nFragmented activities or contracts being aggregated when considering whether a POB exists\nBuilding site\, construction\, installation\, assembly project and related supervisory activities exceeding 5 months in in aggregate in any 12-month period would trigger a POB\n\nWhere there is POB in Malaysia\, the profits attributable to the POB in Malaysia shall be deemed derived from Malaysia and is subject to Malaysian income tax. The challenging issue here is the profit attribution for the Malaysian operations of the NR\, which is complex and often subject to dispute. The likelihood and impact of cyber risks is increased with remote and mobile working”. \nBusinesses that embrace the concept of digital transformation perform better. Yet\, three in five businesses in the Asia Pacific region (APAC) have put off digitisation out of fear of cyber-attacks. The challenge for both businesses and governments is to make sure that they are protected and prepared\, even more now than ever before. Technology is enabling many businesses to allow employees to work from home\, technology is empowering students with remote learning and securing IT in health systems. Digital business focuses more on how technology allows companies and people to create new value and experiences that differentiate them and give them a competitive edge over their peers. \nAgainst this backdrop\, Deloitte Access Economics and VMware have launched a new report\, “Cyber Smart – Enabling APAC businesses”. In this report\, Deloitte Access Economics analyses cyber exposure\, preparedness and economic opportunity across 12 economies in APAC. Singapore ranks #1. This research finds that improving preparedness could increase APAC GDP by US$145 billion in the long term and spur the growth of what is already a US$22 billion industry. \nLooking at government frameworks and organisational capability across the region\, the report finds that nations with higher exposure to cyber risks tend to be more prepared. More developed economies are the most exposed. But with an average index score of 56 out of a best practice of 100\, APAC’s preparedness must improve. Clearly\, governments have the appetite to support cyber smarts.
